Acceptance of Terms

By accessing or using DialFlix ("the Service"), you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to comply with these Terms and Conditions and all applicable US federal and state laws.

If you are using DialFlix on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

Service Description

DialFlix is a cloud-based Voice over IP (VoIP) phone system providing inbound and outbound calling, SMS messaging, voicemail, contact management, and related communication tools accessible via web browser.

DialFlix operates as an interconnected VoIP provider and is subject to oversight by the Federal Communications Commission (FCC) and applicable federal telecommunications laws including the Communications Act of 1934, as amended.

Plans, Minutes & Pricing

Each plan includes a monthly allotment of combined inbound and outbound calling minutes. Minutes reset on your billing anniversary date each month and do not roll over.

Add-on packs stack on top of your plan's included minutes. You are only charged for the add-on if you purchase it โ€” there are no automatic overages or surprise charges.

Fair Usage Policy

DialFlix plans are intended for legitimate individual business use. To ensure a high-quality experience for all users, the following fair usage rules apply:

Abnormal usage may trigger a review

Accounts showing patterns inconsistent with individual use (e.g., hundreds of short-duration calls per hour) may be temporarily suspended pending review.

Permitted Calling Hours (TCPA)

Under the Telephone Consumer Protection Act (TCPA) and FCC regulations, calls and text messages to consumers must only be made during permitted hours in the recipient's local time zone.

TCPA violations carry serious penalties

Fines range from $500 to $1,500 per violation. DialFlix is not liable for TCPA violations caused by user behavior. Users are solely responsible for compliance with calling hour restrictions.

TCPA Compliance

The Telephone Consumer Protection Act (TCPA), 47 U.S.C. ยง 227 restricts telemarketing calls, auto-dialed calls, prerecorded voice messages, text messages, and unsolicited faxes. All DialFlix users must comply with TCPA in full.

What counts as consent?

Written consent must clearly authorize you to contact the person using an automated system or for marketing purposes. Verbal consent alone is generally not sufficient for TCPA purposes.

FCC Regulations

DialFlix operates in compliance with the Federal Communications Commission (FCC) rules and the Communications Act of 1934, as amended by the Telecommunications Act of 1996.

Users must comply with all applicable FCC regulations, including but not limited to:

DialFlix cooperates fully with FCC investigations and law enforcement requests relating to user activity on our platform.

Anti-Spoofing Policy (TRACED Act)

The Telephone Robocall Abuse Criminal Enforcement and Deterrence (TRACED) Act and the FCC's Truth in Caller ID rules strictly prohibit caller ID spoofing intended to defraud or harm recipients.

Zero tolerance โ€” immediate account termination

Any use of DialFlix to spoof caller ID with intent to defraud, mislead, or harm will result in immediate and permanent account termination, reporting to the FCC, and cooperation with law enforcement.

Anti-Scam & Fraud Policy

DialFlix has a strict zero-tolerance policy for any use of our platform to facilitate scams, fraud, or deceptive practices. This includes but is not limited to:

DialFlix employs automated and manual monitoring to detect fraudulent call patterns. Suspicious accounts are immediately suspended and reported to relevant authorities including the FCC, FTC, and law enforcement agencies.

Criminal liability

Telephone fraud is a federal crime under 18 U.S.C. ยง 1343 (wire fraud) and other statutes. Penalties include up to 20 years imprisonment. DialFlix will cooperate fully with any federal investigation.

SMS & Text Messaging

SMS is a Pro plan feature only. Individual Basic plan users do not have access to SMS sending or receiving. All text messages sent via DialFlix must comply with TCPA, the CAN-SPAM Act, and CTIA Messaging Guidelines.

10-DLC Brand Registration & Campaign Approval

Under FCC and mobile carrier regulations, any business sending SMS messages in the United States is required to register their brand and have their messaging campaign approved through the 10-DLC (10-Digit Long Code) system. This is a federal requirement โ€” not optional. DialFlix cannot enable SMS sending on your account until registration and approval are completed.

What is 10-DLC registration?

10-DLC is an industry-wide standard mandated by US carriers (AT&T, Verizon, T-Mobile) to reduce spam and ensure businesses sending SMS are verified. Without it, your messages will be blocked or filtered by carriers.

If your brand registration is rejected on the first attempt, you are entitled to one free appeal at no additional cost. If the appeal is also unsuccessful, the $40 brand registration fee will be refunded to your original payment method within 5โ€“10 business days. The $15 processing fee is non-refundable in all cases as it covers third-party carrier submission costs.

Registration takes time

Brand registration and campaign approval typically takes 1โ€“3 weeks depending on carrier review queues. You will not be able to send SMS until approval is confirmed. We recommend submitting registration as soon as you subscribe to the Pro plan.

Account Suspension & Termination

DialFlix reserves the right to suspend or terminate any account immediately and without prior notice for:

Upon termination, your access to the service ends immediately. You remain liable for any fees accrued up to the termination date. DialFlix may report violations to the FCC, FTC, or law enforcement as required by law.

Privacy & Data

DialFlix collects and processes personal data as described in our Privacy Policy. By using the service you consent to this processing.

Limitation of Liability

DialFlix provides its service on an "as is" and "as available" basis. To the maximum extent permitted by applicable law:

Nothing in this section limits liability for death, personal injury caused by negligence, or fraud.

Contact & Disputes

These Terms are governed by the laws of the United States and the state in which DialFlix operates, without regard to conflict of law principles.

Any disputes arising under these Terms shall first be attempted to be resolved informally by contacting us. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA).
